# Terms of Use
**Wakekin — Alarm & Morning Ritual**

## 1. Acceptance of Terms
By downloading, installing, or using Wakekin ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
## 2. Description of Service
Wakekin is a morning alarm application that combines alarm functionality with a virtual pet companion and daily ritual system. The App includes features such as customizable alarms, morning challenges, Wake Up Check, mood tracking, streak tracking, and a virtual pet companion.
## 3. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement.
## 4. User Accounts
When you set up Wakekin, you provide a display name and a pet name. These are stored locally on your device. You are responsible for the information you provide. No email or password-based account is required.
## 5. Subscriptions and Payments
### 5.1 Free and Premium Features
Wakekin offers both free features and an optional premium subscription ("Wakekin Pro") that unlocks additional content including:
- 8 premium alarm challenges (Memory, Puzzle, Draw, Bubble Pop, Type the Quote, Color Match, Maze Runner, Whack-a-Mole)
- Multiple Missions (up to 3 challenges per alarm)
- Wake Up Check (post-alarm wakefulness verification)
- Streak Shield (monthly streak protection)
### 5.2 Billing
All payments are processed through Apple's App Store. By subscribing to Wakekin Pro, you agree to Apple's payment terms. Subscription prices are displayed in the App before purchase.
- **Monthly**: Billed monthly at the price displayed in the App.
- **Yearly**: Billed annually at the price displayed in the App.
Prices may vary by region and are determined by Apple's App Store pricing.
### 5.3 Free Trial
Wakekin Pro may offer a free trial period. If offered:
- The trial duration and subsequent pricing are clearly displayed before you subscribe.
- You will not be charged during the free trial period.
- If you do not cancel before the trial ends, your Apple ID account will be automatically charged at the displayed subscription price.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
### 5.4 Auto-Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
### 5.5 Cancellation
You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period. No refunds are provided for partial billing periods.
### 5.6 Restore Purchases
You can restore previously purchased subscriptions using the "Restore Purchases" option in the App's Settings.
### 5.7 Downgrade Behavior
When your subscription expires or is canceled:
- Premium challenges will be locked. Alarms using premium challenges will revert to free alternatives.
- Multiple Missions will be reduced to a single mission.
- Wake Up Check will be disabled on all alarms.
- Streak Shield will become unavailable.
- Your streaks, pet progress, and ritual history will be preserved.
## 6. Alarm Functionality Disclaimer
**Important**: Wakekin is a third-party alarm application and is subject to iOS system limitations.
- The App relies on iOS local notifications and AlarmKit (iOS 26+) to deliver alarms. Device settings such as Do Not Disturb, Low Power Mode, system volume level, or background app restrictions may affect alarm delivery and sound.
- Wakekin should **not** be relied upon as your sole alarm if punctuality is critical for safety, employment, or other important obligations.
- We strongly recommend keeping your device volume at an audible level and ensuring the App has notification permissions enabled.
- We are not responsible for missed alarms due to device settings, iOS restrictions, system updates, or device malfunction.
## 7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to reverse engineer, decompile, or disassemble the App.
- Modify, adapt, or create derivative works based on the App.
- Remove any copyright or proprietary notices from the App.
- Use the App in any way that could damage, disable, or impair the service.
- Exploit any bugs or vulnerabilities in the App.
## 8. Intellectual Property
All content, features, and functionality of the App — including but not limited to the design, graphics, animations, sounds, text, and software — are owned by Wakekin and are protected by copyright, trademark, and other intellectual property laws.
The virtual pet character designs, alarm sounds, challenge designs, and morning ritual content are proprietary to Wakekin.
## 9. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The App will function in all device states, configurations, or iOS versions.
- The App will be uninterrupted, error-free, or completely secure.
- Any specific results will be achieved from using the App.
- Alarms will always fire reliably under all circumstances.
## 10. Limitation of Liability
To the maximum extent permitted by applicable law, Wakekin and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data
- Missed alarms or late wake-ups
- Any damages resulting from your use or inability to use the App
- Any damages resulting from subscription billing issues handled by Apple
Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
## 11. Account Deletion
You may delete your account and all associated data at any time through the "Delete Account" option in Settings. This action is permanent and cannot be undone. All locally stored data including your profile, pet, streaks, mood history, and alarm configurations will be permanently erased from your device.
**Note**: Deleting your account does not cancel your subscription. You must cancel your subscription separately through Settings > Apple ID > Subscriptions.
## 12. Modifications to Terms
We reserve the right to modify these Terms of Use at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the modified terms.
## 13. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
## 14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
## 15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law provisions.
